Granting some relief to a Burail tea vendor who lost his son by drowning in a pond at a park in Sector 33 in 2005, the Punjab and Haryana high court has directed the Chandigarh administration to pay him a compensation of Rs. 8 lakh. The directions came from the court headed by justice Ritu Bahri on a petition filed by Rattan Chand, father of the deceased master Pawan Kumar.
On August 3, 2005, his son, a Class-9 student, was returning home from Government Higher Secondary School, Sector-32, when he slipped into the pond and died on the spot.
“Therefore, the necessary conclusion is that after making a pond in the park, it was the duty of the administration to post police officials for monitoring, so as to prevent such kind of incident,” said justice Bahri.
The court has directed the administration to pay compensation to the petitioner within four weeks and to send the compliance report to the court.
The father had approached the high court seeking compensation, alleging that the officers had not properly maintained the park, resulting in a big low-lying area, which ultimately got converted into a pond in the rainy season in which his son drowned.
Appearing for the petitioner, senior advocate Satya Pal Jain argued that it was due to the gross negligence on the part of officials in the administration that they did not maintain the low-lying area, which ultimately got converted into a pond in the rainy season.
Jain had informed the court that deceased’s father was a tea seller on a footpath in Burail and had two sons and two daughters to feed. However, the UT administration had paid him a meagre amount of Rs. 20,000 as compensation. This was spent on the last rites.
