In case a decree is passed for judicial separation and there is no resumption of cohabitation by parties to marriage for a period of one year or more after such decree, then either the husband or the wife can file a petition seeking divorce. A few such instances include: Insulting husband deliberately in front of relatives, gross neglect, continuous denial of sex without reasonable cause, suicidal threats, undergoing an abortion against husband's will without reasonable cause, allegations attributing illicit affairs to husband, false allegations of cruelty against husband etc.<br />

In her claim, Sunita told the court that her son was working as a mason with a Bhiwandi-based contractor and lost his life in a road accident. <br />

She further said in her submission to the court that her son was travelling to Mumbai in a luxury bus which met with an accident and he died. <br />
<br />
The woman claimed that the accident occurred due to rash driving and was a negligence on the part of the driver and made a claim of Rs 5 lakh. <br />
<br />
A case was registered by the Kankavli Police Station against the driver of the bus. <br />
<br />
The judge in his order stated that, based on the deceased's monthly income, the total loss of dependency to the applicant was worked out to the extent of Rs 8.10 lakh, while an additional of Rs 15,000 was granted towards other expenses.<br />

The NGO, whose Kolkata chapter is known as Hridaya-Nest, developed the mobile application keeping in mind a growing tribe of males who are becoming victims of the alleged misuse of Section 498a of the IPC and anti-rape laws. ‘The response is huge. The app has received near about 5,000 downloads over the last four months,’ Amit Gupta of Hridaya-Nest said.<br />

The APP offer details of 50 NGOs in 50 cities in 25 states where people could personally seek legal counselling and support. The helpline which was initially launched in 10 states including MP, Delhi NCR, Karnataka and Uttar Pradesh, Madhya Pradesh, Bihar, Rajasthan, Haryana and other states, has been extended to five more states.<br />

‘Each state has five counsellors at an average. The highest number of calls have been received from Madhya Pradesh with 31 per cent calls,’ Gupta said and claimed that they had received calls and responses from even foreign countries such as Singapore, UK, Japan and USA.<br />

Among the cities, the maximum number of calls, 23 per cent of all, have been received from Delhi, while the lowest, one per cent, have been received from Vizag. Gupta said that the NGO has a plan to take it to all cities and towns in India after an increasing number of males became victims of ‘gender biased laws’.<br />
<br />
‘According to a survey done by us last year, every nine minutes a married man commits suicide in India due to alleged misuse of section 498a of IPC against them, taking the toll to around a whopping 64,000 every year,’ said Gupta.<br />

While the state-controlled SIT submitted chargesheets only under Sections 406 (criminal breach of trust), 409 (criminal breach of trust by a public servant), 420 (cheating) and 120B (criminal conspiracy) IPC, the probe by Serious Fraud Investigation Office found violations under IPC 107 (abetment of crime), 403 (dishonest misappropriation of property), 415 (cheating), 418 (cheating with knowledge that wrongful loss will be caused), 419 (impersonation) and 477A (falsification of accounts), apart from those mentioned by SIT, the ministry's statement said.<br />

The ministry said the companies that have violated Sebi regulations for "collective investment schemes" will be prosecuted under Sebi Act instead of Companies Act, because it carries longer terms of imprisonment. State governments will have to initiate prosecution under Prize Chits and Money Circulation Scheme (Banning) Act. "The companies, their promoters, directors and managerial personnel have been found guilty on many counts of various provisions of the Companies Act... dealing with illegal collection of deposits and false statements, etc," it said.<br />

The state SIT had let its probe slip in a maze of FIRs and chargesheets, unable to track down the labyrinthine transactions of the Saradha Group. In fact, this was one of the factors why Supreme Court handed over the Saradha probe to CBI on May 9. It had asked the state for a sample chargesheet.<br />

"We directed the state to file a sample copy of the chargesheets said to have been submitted before the jurisdictional courts. A perusal of the copies shows that they relate only to individual deposits, leaving untouched the larger conspiracy angle that needs to be addressed," Justice T S Thakur and Justice C Nagappan had mentioned in their judgment.<br />

Worse still, it was also a Trinamool led, which had told the SC that a larger conspiracy angle is being investigated in case No.102 registered in Bidhannagar Police Station (North) on May 6, 2013 under Sections 406, 409, 420, 120B IPC submitting it a list of people the SIT wanted to question.<br />

The SC observed, "A perusal of the synopsis furnished and the names included in the list makes it abundantly clear to us that several important individuals wielding considerable influence within the system at the state and the national level have been identified by the investigating agency for interrogation."<br />

Trinamool national secretary Mukul Roy questioned, "Is Saradha Mamata Banerjee's crime? No. If Mamata Banerjee had not tried to curb Sudipta Sen then would he have been arrested?" Roy alleged that since Independence, CBI has always been used for political gains by the Centre. He said that since CBI is investigating the matter it will have to ensure return of money to the depositors. "You (CBI) will have to tell us as to how you will return the money," Roy said. The SC ruling hasn't left the state-appointed Shyamal Sen Commission in any fretters. The Commission has been paying back depositors from a Rs 500-crore fund provided by the state. "Transfer of investigation to the Central Bureau of Investigation (CBI) in terms of this order shall not, however, affect the proceedings pending before the Commissions of Enquiry established by the State Government or stall any action that is legally permissible for recovery of the amount for payment to the depositors," the order clearly said.<br />

Google Search remains the most important part of Google's business, with advertising on the platform forming the majority of its $60 billion in annual revenue. But now, Germany's government has escalated its antitrust case against the company by requesting that Google publishes how websites are ranked on Google Search.<br />

Google has apparently pushed back against the request, claiming that publishing the search engine algorithm would mean revealing its business secrets and opening up the service to exploitation by spammers.<br />
<br />
The European Union has been working for four years to try and break up Google's dominance over web search in Europe. As the Wall Street Journal reports, Google handles over 90% of web searches in Europe, a larger percentage than its 68% share of the American search market. The EU has continually pushed Google to make concessions in the way it displays search results, the most notable of which is the "right to be forgotten" law that means private individuals in the EU can force Google to de-list web pages about them. Last week the EU rejected a proposed compromise from Google, meaning that the company could still face a $6 billion fine.<br />

New Delhi: Maruti Suzuki India Ltd, the nation’s biggest car maker, and 13 other car makers were fined Rs.2,554 crore by the antitrust regulator for failing to sell spare parts in the open market, violating competition law. The other companies on which penalties have been imposed include Mahindra and Mahindra Ltd, Tata Motors Ltd, Toyota Motor Co., Honda Motor Co., Volkswagen, Fiat, Ford Motor India Pvt. Ltd, General Motors, Nissan, Hindustan Motors, Mercedes and Skoda. Car companies denied access to branded spare parts and diagnostic tools to independent repairers, hampering their ability to repair and maintain certain car models, the Competition Commission of India (CCI) said in a statement on Monday.<br />

The monopolistic control over the spare parts and diagnostic tools markets allowed these companies to charge arbitrary and high prices, it said. “The commission found that the conduct of the car companies was in violation of the provisions of section 3(4) of the Act with respect to its agreements with local original equipment suppliers (OESs) and agreements with authorized dealers whereby it imposed absolute restrictive covenants and completely foreclosed the after-market for supply of spare parts and other diagnostic tools,” CCI said in the statement. The competition regulator has directed the car companies to “cease and desist from indulging in conduct which has been found to be in contravention of the provisions of the Act”.<br />

The car companies were also directed by the commission to put in place an effective system to make the spare parts and diagnostic tools easily available in the open market for customers and independent repairers. It also asked the car companies not to put any other restrictions on the operation of independent repairers.<br />

Tata Motors was fined Rs.1,346.46 crore, the highest, followed by Maruti Suzuki at Rs.471.14 crore and Mahindra and Mahindra at Rs.292.25 crore. Toyota Kirloskar Motors will have to pay Rs.93.38 crore, General Motors Rs.84.58 crore; Honda Rs.78.47 crore, Skoda Auto India Rs.46.39 crore, Ford India Rs.39.78 crore, Fiat India Automobiles Ltd Rs.29.98 crore, Mercedes-Benz- Rs.23.08 crore, BMW India Ltd Rs.20.41 crore, Hindustan Motors Rs.13.85 crore, Volkswagen India Pvt. Ltd Rs.3.25 crore and Nissan Motors Rs.1.63 crore.<br />

A Tata Motors spokeswoman said she did not have any official information until late Monday evening. Hyundai, Honda and Ford, too, declined to comment immediately. The regulator’s investigation into the practices of the car makers followed a complaint by Shamsher Kataria, who had complained that car makers were following anti-competitive practices by restricting the sale of spare parts. Kataria had filed the complaint in January 2011 against Honda Cars India Ltd, Volkswagen India and Fiat India Automobiles Ltd In April 2011, CCI extended its probe to other manufacturers when it found others following similar practices. Hyundai had obtained a stay order from the Madras high court against CCI’s proceedings in February 2013. The company argued CCI had, on its own, expanded the scope of its investigation to cover the entire car industry even though it had originally received a complaint only against the three car makers.<br />

The commission had investigated 17 companies in the case. The three that were not immediately fined are: Premier Ltd, Mahindra Reva Electric Car Co. and Hyundai Motor India Ltd. The commission however said that a separate order shall be passed with respect to them “after affording them reasonable opportunity to make their submissions in respect of the findings.” On 8 July, Business Standard newspaper reported that the Madras high court dismissed petitions of Nissan Motors India Pvt. Ltd and Hyundai Motor India against the decision of CCI to initiate investigation against all car manufacturers. On 13 August, Mint had reported that some of the companies being probed had begun selling spare parts over the counter, even as the CCI probe was on. These included Ford Motor India, Hyundai Motor India and Tata Motors.<br />

The high court said that the issue of validity of the sanction to prosecute accused Rakesh Kumar, former Director General (DG) of Indian Council for Cultural Relations (ICCR), would be decided by the trial court.<br />

Justice VP Vaish passed the order while referring to a Supreme Court decision in a similar matter in which it was held that "interdicting" a criminal proceeding mid-course on ground of invalidity of the sanction order will not be appropriate unless the court can also reach the conclusion that failure of justice had been occasioned.<br />

"It is a settled law that any error, omission or irregularity in the grant of sanction will not affect any finding, sentence or order passed by a competent court unless in the opinion of the court a failure of justice has been occasioned.<br />
"In view of the dictum of the Supreme Court of India in Rajmangal Ram's case, this Court is of the view that it is not appropriate to quash proceedings on the ground of invalidity of the sanction during mid-course of the trial proceedings.<br />
The same will be considered by the trial court after the evidence is adduced by both the parties," the court said.<br />
Kumar had challenged the trial court's January 2013 order dismissing his plea against the sanction order to prosecute him.<br />

BANGALORE: The High Court has asked the lower judiciary to be cautious while interpreting and translating statutes from English to Kannada as there is no official translation available.<br />

Justice Anand Byrareddy was hearing an appeal filed by M/S Alhind Tours and Travels against the order of the magistrate on dismissing a complaint and acquitting the accused company Taha International.<br />
<br />
The magistrate court had passed the order in Kannada. Provisions of the Negotiable Instruments (NI) Act, 1881, the Criminal Procedure Code (CrPC) were translated to Kannada. The court found that the translation also reflected the personal views of the judge at some point.<br />
<br />
Hence, Justice Byrareddy observed that caution would have to be exercised while interpreting the provisions of law or in addressing the nuances of the involved principles of law and pronouncing the same in Kannada, which may not be accurately reflected.<br />

He observed that the court was fully conscious of the need to employ Kannada at all levels. The trial court may keep in view that there is no official translation in Kannada of the Negotiable Instruments Act, 1881, CrPC, 1973 or any other Central Act, let alone the oceanic body of case law. “The higher courts may not be able to appreciate the correctness or otherwise of the views and opinions so expressed, which incidentally would be a seminal and personal view of the trial court judge, in Kannada, especially if the judges of the higher court are not as well versed as the trial court judge in the nascent and laboured legalese, in Kannada,” he added.<br />

New Delhi: A Delhi court has acquitted a man of the charge of raping a five-year-old girl after the child retracted from her statement.<br />

Additional sessions judge Rajneesh Kumar Gupta freed the man, a resident of Ranjeet Nagar here, saying there was no evidence against him and the victim child deposed in the court that he did not do anything wrong with her.<br />
<br />
"From the evidence on record, no substantive evidence has been come on record to prove that the accused has inserted a stick in the private part of the prosecutrix (child).<br />
<br />
"Accordingly, the prosecution has failed to prove its case against the accused and the accused is acquitted of the charge," the court said while absolving the man of the charge of rape and aggravated sexual assault.<br />
<br />
According to the prosecution, an FIR was lodged against the man in May last year regarding rape of the minor.<br />

The complaint was made by the girl's mother alleging that when she had gone for work, the accused, who was known to them, took her daughter to his house on the pretext of giving her food and raped her by inserting a stick in her private part.<br />

The woman came to know about this when she returned home and the child complaint of pain, the police said, adding that the man was arrested.<br />
<br />
The child changed her statement in the court and deposed that the man had called her to his house to have some rice and at that time he was sweeping the floor with a broom. She said accidentally a broom stick struck her private part.<br />
<br />
During the trial, the man claimed innocence and denied the allegation levelled against him.<br />
<br />
The court acquitted the man, saying no such material has come on record which would support the case of prosecution.<br />
<br />
It said the girl's statement recorded before a magistrate was a corroborative piece of evidence and the conviction cannot be based on the statement alone, unless there was a substantive evidence on record to prove the case.</div>

NAGPUR: Dismissing the WCL plea, Nagpur bench of Bombay High Court imposed a cost of Rs5,000 on it for denying the claim of Ravi Kumar who applied for workman's job on compassionate ground after his father Puranlal's death. WCL had challenged Industrial cum Labour Court's order that quashed and set aside its action of rejecting the demand of Ravi.<br />

Terming it as unjustified and illegal, labour court had directed the WCL to grant employment to him according to his skill and qualification within a month. After expiry of Puranlal on November 26, 1997, his widow had applied for granting employment to their son on compassionate grounds on June 12, 1998. But, WCL rejected it on April 26, 2001. The union raised an industrial dispute on widow's behalf. As the conciliation efforts failed, the dispute was referred to Labour Court, where WCL's contention was rejected.<br />
<br />
The company challenged it in the high court contending that since the reference for Kumar's appointment was made by the union and the application for job was filed by the widow, it was against laws. It stated that Kumar can't be member of the union as he was not 'workman' as per Industrial Disputes Act, 1947, and hence the Labour Court had no jurisdiction to consider his claims. It added that the Kumar's claim was rejected since there was variation in his age as per the documents.<br />
<br />
Citing National Coal Wage Agreement-VI, Kumar argued that the company is under obligation to give employment to one dependent of the deceased employee. As per clause 9.3.3, the son of the deceased employee is included in the term 'dependent' and therefore, he was entitled for the appointment on compassionate ground.<br />

Justice ZA Haq observed that the WCL's conduct was completely unjustified. "The company hasn't given any justification for not providing employment to the widow'. There is no justification from them for not making available monetary compensation to her. The explanation given by them for not considering the claim of the respondent for appointment on compassionate ground that there was variation in the date of his birth, is nothing but an attempt to justify its illegal conduct," the judge tersely observed.<br />

"There is no reason to deny locus to the dependent of the deceased employee on the basis of National Coal Wage Agreement in case of latter's death. The objection raised by the petitioner that Kumar had no locus to file case in the Labour Court can't be accepted," the court ruled before asking the WCL to pay cost to the respondent before November 30.<br />

Granting some relief to a Burail tea vendor who lost his son by drowning in a pond at a park in Sector 33 in 2005, the Punjab and Haryana high court has directed the Chandigarh administration to pay him a compensation of Rs. 8 lakh. The directions came from the court headed by justice Ritu Bahri on a petition filed by Rattan Chand, father of the deceased master Pawan Kumar.<br />
<br />
On August 3, 2005, his son, a Class-9 student, was returning home from Government Higher Secondary School, Sector-32, when he slipped into the pond and died on the spot.<br />
<br />
“Therefore, the necessary conclusion is that after making a pond in the park, it was the duty of the administration to post police officials for monitoring, so as to prevent such kind of incident,” said justice Bahri.<br />

The court has directed the administration to pay compensation to the petitioner within four weeks and to send the compliance report to the court.<br />

The father had approached the high court seeking compensation, alleging that the officers had not properly maintained the park, resulting in a big low-lying area, which ultimately got converted into a pond in the rainy season in which his son drowned.<br />
<br />
Appearing for the petitioner, senior advocate Satya Pal Jain argued that it was due to the gross negligence on the part of officials in the administration that they did not maintain the low-lying area, which ultimately got converted into a pond in the rainy season.<br />
<br />
Jain had informed the court that deceased’s father was a tea seller on a footpath in Burail and had two sons and two daughters to feed. However, the UT administration had paid him a meagre amount of Rs. 20,000 as compensation. This was spent on the last rites.<br />

Hyderabad: Around 1000 acres of forest lands have been encroached in the proposed AP capital region. The AP government has decided to evict encroachers in the Krishna and Guntur districts around Vijayawada city. During a preliminary inquiry it was found that in Krishna and Guntur districts hundreds of acres of government land including forests has been illegally occupied by some persons. The government has asked officials to provide details about the illegal occupation of government land and forest land in Krishna and Guntur districts, particularly around Vijayawada.<br />

AP forest department officials told the government that near Vijayawada in the Nuzividu forest area around 1,000 acres have been illegally occupied. According to a rough estimate in Krishna and Guntur districts around Vijayawada city hundreds of acres of government land has been illegally occupied. Officials are working out ways to collect details about government and forest land under illegal occupation. The encroachments came to the notice of officials after the government’s decision to build the capital around Vijayawada. According to sources the government will ask the encroachers to vacate the lands. After giving some time to the encroachers the government will take action against them.<br />

The AP government is of the opinion that for construction of the new capital around Vijayawada 20,000 to 30,000 acres is required. According to the McKinsey plan the new capital will have 49 buildings with 44 floors each. Senior officials want the AP capital to be an administrative centre. Inside the city polluting industries will not be allowed. The plan envisages the construction of a secretariat, Assembly buildings, Raj Bhavan, High Court, and residential quarters for ministers, MLAs, MLCs, IAS and IPS officers and government offices.<br />

The association of liquor and beer suppliers, in its petitions, said that the distillery units were told to install the required hardware by May 30, 2014. It further stated that only HEALs would be used from July 1 onwards. A representation was made to the authorities explaining the difficulties faced by the distilleries in installing the hardware.<br />

"Procuring hardware for affixation of HEALs is an expensive affair, with the distilleries having to bear high cost which will, in turn, adversely affect their business and consequently the industry in general. Members of the association could not procure the requisite hardware and have been manually affixing HEALs to the bottles from July 1 onwards," it explained.<br />

The petitioner requested the authorities to exempt them from purchase and installation of the said equipment. Principal secretaries and commissioners of prohibition and excise, managing directors of beverages corporation limited of Telangana and AP states were named as the respondents.<br />

Finding fault with the attitude of the Chief Executive Officer of Khammam Zilla Parishad in interfering with the possession and enjoyment of a private land, Justice MS Ramachandra Rao of the Hyderabad High Court directed the official to pay Rs 15, 000 costs to the petitioners for causing mental agony to them.<br />
<br />
The facts of the case are that Dr. B. Nagesawara Rao and Dr. B. Sridevi moved the High Court in 2013 challenging the action of the authorities in interfering with the peaceful possession and enjoyment of house plot situated at Khammam. They said that the land was purchased in 1981 and it is in their possession.<br />
<br />
The ZP authorities have contended that the land actually belonging to the government and it was acquired to construct quarters for ZP staff.<br />
<br />
As the authorities raised objection against possession and their owner ship of the land, the petitioners approached the government and a survey was conducted and found that the subject land is outside the land acquired for the in 1966.<br />
<br />
The petitioners told the court despite of the survey findings, the ZP authorities decided to construct a compound wall on their land and damaged the fencing.<br />
<br />
After verifying the records, the judge concluded that the action of the authorities arbitrary, mala fide and with improper motives and cannot be countenanced.<br />
<br />
While allowing the writ petition, the judge directed the respondents to restrain from interfering with the possession and enjoyment of the subject land.<br />

Boundaries are subject to frequent change due to various forces. Therefore, it is very difficult to determine the boundaries of the “Telugu country” across the ages. The course of centuries witnessed various vicissitudes that altered its boundaries. Occasionally natural, economic, administrative and religious sentiments shape the boundaries, but they are not rigid and constant. In the changing scenario of politico-administrative systems, changes will inevitably take place in the fixation of boundaries. Thus geographically, any boundary is subject to change in the course of events, and the province of the Telugu-speaking people is not an exception.<br />
<br />
Satavahanas, the curtain raisers of the history of the Telugu country, started their political career in Telangana and extended their authority to coastal Andhra and Rayalaseema, besides the rest of South India. Beginning with the Salihundam in Srikakulam district, a majority of the monuments belongs to their period. Their coins were found throughout Andhra.<br />
<br />
Their succeeding dynasties, like Ikshvakus and Vishnukundins, held their sway both in Telangana and Andhra. Later, Badami Chalukyas and their offshoot family, Vengi Chalukyas, occupied Andhra and their political enemies, the Rashtrakutas, held their authority in Telangana through their subordinates like the Chalukyas of Vemulavada.<br />

Poet Pampa, who adorned the court of Vemulavada, under Arikesari-II, hailed from Guntur district (Karmarashtra). The same Vemulavada Chalukyas tried to bring political harmony between the rulers of Telangana and Andhra. Though the question of the origin of the Telugu language and literature is enmeshed with a number of problems, inscriptional evidences clearly state that the earliest Telugu sentences occurred in the records of the Renati Cholas of Rayalaseema, and earliest stanzas appeared in Coastal Andhra and Telangana.<br />
<br />
The Gudur inscription of Viriyala Malla of Telangana and the records of Gunaga Vijayaditya and Chalukya Bheema of Coastal Andhra attest to that fact. Thus the Telugu language binds the people as well as their provinces together.<br />
<br />
Matrimonial alliances were also negotiated between the ruling families of Telangana and Andhra to bring integrity. Ganapati Deva married the princess of Krishna district and Rudramadevi was given in marriage to the Prince of Nidadavolu in the West Godavari district.<br />
<br />
Under the Qutb-Shahi rule of Golconda, both Coastal Andhra and Rayalaseema flourished. Almost all the zamindaris of Coastal Andhra, like the Kakarla-pudis, the Pusapatis and many others, were established under the Qutb-Shahis. All such families assisted the Golconda power both administratively and financially.<br />
<br />
The entry of Europeans changed the system. In the establishment of trading companies at different centres, the mutual rivalries of the French and the English form the history of the successive periods. They acquired Northern Circars in the second half of the 18th Century and ceded districts in the beginning of the19th century from Nizam. <br />

I did my schooling in Mandamarry town, Adilabad district. Two historical places are near my place. Kotilingala was the abode of the Satavahana dynasty. Historians even claim that it was the capital of this great empire even before Amaravati. The other important place is Jode Ghat, the tribal village that saw the historic tribal uprising led by the legendary Komaram Bheem.<br />
<br />
Surprisingly, I have never read about these two places in any textbook during my entire school education. But, I read in my textbooks about Draksharamam and Amaravati. My history textbooks taught me about Veera Pandya Katta Brahmana and Kanneganti Hanumanthu. This is not to infer that I should not read them. But, the question that lingers in my mind is why I was denied the right to be taught about the history intimate to me. The peasant uprising of Telangana was completely absent, as it was spearheaded by the Communists. The unparallel sacrifices of Chakali Ailamma or Doddi Komaraiah were deliberately ignored in the textbooks, as they would reveal the heroic struggles of the Communists.<br />
<br />
Whatever may be the reasons, the history and culture of Telangana was under-represented in the popular culture of united Telugu state. On the other hand, Telangana was a separate state as part of the composite Hyderabad state five years before Andhra state was formed. This consciousness coupled with marginalisation of native history and culture fuelled the movement for a separate state.<br />
Not just the textbooks, even the other expressions of popular culture, like films, almost always excluded the places, culture and history of Telangana. Never really was a film hero portrayed as studying in the Osmania University. The most popular festivals, like Bathukamma, hardly found place in Telugu films. All this is despite Telugu films having good market in the Nizam area.<br />
<br />
Against this backdrop, the Telangana government’s decision to rewrite the textbooks should be assessed. People get inspired by their surroundings. Local streams of history should get an adequate representation in the textbooks. State governments decide the textbook policy. The Tamil history and culture obviously did not figure so prominently in the textbooks after the first Telugu state was formed in 1953. But, often mawkish and jingoistic voices, expressed in the name of Telangana pride, even by those in the government, are the basis for suspicion.<br />
<br />
The history and culture of Telangana people cannot be separated from the rich historical and cultural legacy of Telugu people. For that matter children in Telangana need to be taught various facets of Indian history and culture. The legitimate regional aspirations should be welcomed while the parochial manifestations need to be discouraged. Any attempt to deride the culture and tradition of Seemandhra in the textbooks of Telangana should be opposed.<br />
<br />
I am a proud son of Telangana. I am equally proud of my composite Telugu culture and language. I am a patriotic Indian. I am an Asian. And finally I am part of this human civilisation. All these identities are not mutually exclusive, leave alone mutually contradictory. </div>

HYDERABAD: Six months after two software professionals died in a car accident in Kukatpally, the Cyberabad police told the high court that they already filed a chargesheet against the vehicle owner and another person (both friends of the deceased) for trying to hoodwink the cops by saying that one of the victim was driving the car at the time of accident.<br />

Admitting that the intervention of chief justice Kalyan Jyoti Sengupta resulted in nabbing the real culprits, Cyberabad police commissioner C V Anand told the court that they had also arrested the car owner, Soumyajit Basu, in the case. The road accident occurred on March 1 this year.<br />

The car had rammed into a tree near the KPHB junction at 3 am after the driver lost control of the vehicle.<br />
<br />
Initially, Basu, who was at the wheel at the time of the accident, had forced his friend Neeladri (who as also in the car) to put the blame on Sudip Ghosh, one of the deceased, in their statement to the police.<br />
<br />
Basu had even maintained that he was not in the car on that fateful night. The FIR too was registered that way and the police initially believed the theory floated by Soumyajit.<br />
<br />
But as luck would have it, chief justice Sengupta received a letter sometime back from Dr Sujit Mukherjee, a professor from Kolkata, whose son Uttiya Mukherjee too died in this accident, describing how Sudip Ghosh was framed.<br />

After partying till 3 am in the morning, Soumyajit went to drop Neeladri, Souran, Uttiya and Sudip Ghosh in his car and he accidentally hit a tree at Pragati Nagar at KBHB Colony resulting in the death of Sudip and Uttiya on the spot. Other occupants of the car suffered injuries.<br />

Soumyajit prevailed upon Neeladri to tell cops that it was Sudip who was driving the car when the accident occurred. However, Sudip's parents contested this saying that their son did not even know how to drive a car.<br />

<span style="line-height: 20px;">Fourteen AAGs tendered their resignations to the Advocate General N M Lodha while one AAG, Dr Abhinav Sharma submitted his resignation to the High Court and requested the court to forward it to the Governor.</span><br />
<span style="line-height: 20px;">Dr Sharma, appearing in a habeas corpus matter before the division bench of the court comprising Justice Ajay Rastogi and Justice J K Ranka, which asked Law Secretary to appear in person, argued that the comments by the court were unwarranted and that the High Court was not justified in passing remarks against a Constitutional office.</span><br />
<span style="line-height: 20px;">He insisted that if no such comments were made then the High Court must get a corrigendum published.</span><br />
<span style="line-height: 20px;">He argued that the AG is not on payrolls of the state and he is discharging constitutional duties and still the court made observation that the AG is not discharging duties.</span><br />
<span style="line-height: 20px;"><br /></span>
<span style="line-height: 20px;">The court was transgressing its limits which is highly unconstitutional, Sharma said and tendered his resignation to the bench and requested it to forward the resignation to the Governor.</span><br />
<span style="line-height: 20px;">However, the bench refused to accept his resignation. It, then exempted Principal Secretary, Law from appearing before it in the matter.</span><br />

MUMBAI: Legislators against whom criminal charges have either been framed or are under prosecution in various courts are in for a tough time. The state government on Thursday issued a government resolution (GR) forming district and state-level committees to fast-track and monitor day-to-day criminal trials against sitting MPs, MLAs and MLCs. Even legislators who get elected in the ensuing assembly elections will also have to face such speedy trials.<br />
<br />
Since the GR has been issued a day before the code of conduct comes into effect for the assembly polls, it will bring all sitting legislators under the GR's purview. The cases against them will be decided within a year.<br />

"Maharashtra is the first state in the country to act immediately on the recent Supreme Court judgment asking for expediting criminal cases against public representatives in a time-bound manner, and decide on these cases in a year's time" said additional chief secretary (home) Amitabh Rajan.<br />

In a writ petition (civil) filed by Public Interest Foundation and others against the Union of India, the Supreme Court had directed on March 10, 2014, that in relation to sitting MPs and MLAs who had charges framed against them for offences specified in various sections of the Representation of People Act 1951, trials against them should be concluded in a year from the date of framing of the charges. "If the concerned court is being not able to conclude the trial within one year by conducting day-to-day trails, such court %will submit the report to the chief justice of the respective high court indicating special reasons for not adhering to the time limit. In such situation, the chief justice may issue appropriate directions to the concerned courts extending the time for conclusion of the trials," the copy of the GR said.%-Chittaranjan Tembhekar<br />

"The district level coordination committees will comprise principal district judge, district magistrate, district public prosecutor and will create and update the list of all such cases and pending trails against sitting representatives. In case there is a trail pending for more than one year, the chairman of this committee shall send a report to the chief justice of the respective high court indicating special reasons for delay and will intimate state home ministry," said the GR.<br />

A committee under chairmanship of ACS (Home) has also been constituted for the review of such cases at regular intervals at the state level comprising Principal secretary Appeals &Security(Home), Principal secretary law and judiciary, Secretary Home (special), and Director of prosecution.<br />

Additional Sessions Judge Manoj Jain, while discharging the woman, who was the sister-in-law of the alleged dowry victim, termed the allegations as "generic" and "trivial".<br />

"Abuse of section 498A of IPC (subjecting woman to cruelty) is repeatedly increasing but that may not ipso facto mean that every complaint has to be suspected.<br />
<br />
"Of late, there are several judgements and instances which show that this benevolent provision is being misused also by some of the unscrupulous persons," the judge said, while allowing the revision petition filed by the accused woman.<br />
<br />
He said, "I cannot shut my eyes to the fact that revisionist (woman) was already married and was working and residing at a different station.<br />
<br />
"Moreover, the allegations attributed to her are indeed very generic and trivial keeping in mind the fact that these are stated to be spread over the period of seven years or so. These stray allegations seem to be too minor to justify trial for a serious offence of cruelty under section 498A IPC."<br />

The woman had filed a revision petition against the trial court order charging her under section 498A with section 34 of IPC (husband or relative of husband of a woman subjecting her to cruelty with common intention).<br />

The woman had claimed that allegations were very general and vague and there was nothing which may show that she made any demand of dowry or harassed the complainant for dowry and, therefore, there was no occasion for the trial court to have charged her for the offence.<br />
<br />
The complainant had alleged that her sister-in-law had rebuked, taunted her and had sided with her mother-in-law to go for abortion, when it was learnt that she was carrying a female foetus.<br />
<br />
The judge, however, refused to buy the arguments and allegations and said, "I would merely say that the allegations are too general in nature. These create a 'mere suspicion' as opposed to 'strong suspicion'."<br />

BHOPAL: A woman was set ablaze by her mother-in-law over suspicion of theft in Subhash Colony on Sunday. The victim remains critical in hospital while the accused is yet to be arrested. A case under sections of attempt to murder was registered at Ashoka Garden police station.<br />

Suspecting her of stealing washing powder, the accused Vidya fought with 30-year-old Pinky, wife of Lal Chand. Soon the argument took an ugly turn and Vidya set her daughter-in-law ablaze, police said.<br />

Victim's husband Lal Chand, who deals in centring work, and other family members were at home at the time of incident, but it was too late by the time they could hear her screams and come for her rescue.<br />

The woman was rushed to a hospital where her condition is stated to be critical. Police said that in her statement, Pinky told her mother-in-law set her ablaze suspecting that she took her washing powder.<br />

The accused is yet to be nabbed. Pinky got married to Lal Chand around ten years back and has a son. While her husband's family is from bordering state Uttar Pradesh, she hails from TT Nagar area of the city.<br />

“You may have good case for suspension of sentence but not for conviction,” the bench comprising by Justice S J Mukhopadhaya and P C Pant observed.<br />

The observations assumes importance as the “Dabangg” star in his affidavit filed on August 27 has told the apex court that he has always been treated as an ordinary citizen by courts and never been given any special privilege.<br />

The 48-year-old actor had opposed the stand taken by Rajasthan government which had submitted that the high court had granted special privileges to him by staying his conviction in which he was sentenced by a trial court to undergo five-year jail term.<br />

On July 9, the apex court had issued notice to Khan on a plea by Rajasthan government challenging the high court decision.<br />

Can't medical tests for impotence and frigidity be made mandatory before wedding? What's the punishment for impotent or frigid people who suppress the fact before marriage? And what's the remedy for the aggrieved parties? These were some of the questions of the Madras High Court, to which the Central and the Tamil Nadu governments should have a reply on September 5.<br />

The court has also directed both governments to provide statistics on impotence and frigidity cases.<br />

It began with a 25-year-old woman seeking divorce under the Domestic Violence Act at the Family Court in Trichy a year after marriage, claiming her 32-year-old husband was impotent.<br />

The husband moved High Court to quash her petition, claiming that she could not file it without medical evidence.<br />
<br />
"The couple is well-educated. Though the issue is between the two individuals, Justice K Kirupakaran added the state and the central governments suo motu," Mr P Muthu Vijaya Pandian, counsel for the man, told NDTV.<br />

The woman's lawyer was not reachable.<br />

The number of marriages that failed due to impotence had increased from 88 in 2009 to 715 in 2013, the court said, quoting data from the Chennai family court. Taking note of the social factor, the judge said such marriages are conducted "to avoid social stigma or at the compulsion of the elders," suppressing the weakness or disability of one of the partners, reported PTI.<br />
